抄録

　中国は改革開放政策の一環として1980年代以降に西側諸国が構築した国際経済法の諸制度に加入し、国際経済法の普遍化が達成された。その過程で中国の国内体制にいかなる変容が生じたか、また、普遍化した国際経済法にいかなる質的変容が生じたかを考察する上で、中国の国際経済法研究者の第一世代を代表する陳安教授の国際経済法論集は格好の素材を提供する。論集から明らかになるのは、陳安教授の国際経済法学を通底するプラグマティズムと、中国を平和的台頭を希求する発展途上国と位置づけ、その経済発展に質する国際経済法の法理と諸制度を追求する姿勢である。

abstract

China joined the system of international economic law (IEL) in the 1980s when it promoted the policy of reform and opening-up (改革開放), by negotiating accession to the GATT and later WTO and by concluding bilateral investment treaties. This article seeks to elucidate the characteristics of China’s IEL policy from the 1980s through the 2010s by reviewing the collected papers of Professor An Cheng (陳安), a leading scholar of IEL representing the first generation of Chinese IEL scholars. Professor Cheng wrote extensively on the jurisprudence of IEL, the law of international trade and international investment law. His scholarship is characterized by (i) a pragmatic approach to the subject matter, aiming at pursuing the most appropriate direction for China’s policy objectives, and by (ii) a consistent approach to pursue China’s interest as a large developing country aiming at peaceful rise. Accordingly, Professor Chen’s argument conforms to China’s IEL policy since the 1980s until recently. Now that China has become the world’s second largest economy, China is expected to lead the development of IEL by supporting the multilateral trading system and liberal international investment law. Professor Chen’s pragmatism gives us guidance to direct China’s new role in IEL.
