抄録

バーゼル自己資本規制の国内採用以来,日本はその遵守を疑問視され続けてきた.本稿は,どのような政治力学のもと日本の規制当局が遵守から逸脱したのかを論じる.90年代における日本の遵守状況を実証的に検討することによって,国際レベルの遵守メカニズム(国際制度,大国の影響力,市場規律)や小選挙区制度がプルーデンシャル規制を支える基盤を作り出すといった論考が想定するほど遵守を促進するメカニズムが働いていなかったことを明らかにする.国内諸制度の機能不全が銀行規制の混乱を引き起こす中,不良債権問題への取り組みの遅れがバーゼル規制への実質的な遵守を阻害したばかりでなく,プルーデンシャル規制を軽んじる傾向のある政治家の銀行規制政策決定過程への介入を呼び込むことによってさらなる逸脱につなかったのである.

abstract

This paper examines sources for the Japanese weak compliance with the Basle capital adequacy standards in the 1990s. This paper first outlines a set of policy behaviours and economic outcomes against which to test mainstream arguments about compliance, and argues that the institutional dysfunction of domestic banking regulation had two implications for the degree of Japanese compliance. First, the delay in dealing with banks'non-performance loans contributed to the defection from the Basle accord. Second, the severity of the 1998 banking crisis led Liberal Democratic Party politicians to take lenient regulatory policies. For the politicians, the strict implementation of capital adequacy rules could only aggravate the existing credit crunch and was therefore best avoided. This paper presents a counterexample to systemic-level arguments about compliance mechanisms and an argument that the 1994 electoral system provided a political basis for prudential regulation in Japan.
