抄録

 本稿では,ジョン・ロールズの『正義論』を規則と実践の概念から理解することを試みる。規則と実践は,ロールズの初期の作品における重要概念だが,これらの概念がその後のロールズのプロジェクトにおいて意味を果たすのかということを,ジョン・サールの『言語行為』に基づきながら明らかにする。特に,サールの構成的規則と制度的事実の概念は,ロールズの正義論における出発点となっている実践と深く結びついている。この点を鍵として,ロールズの初期の作品と『正義論』の連続性を示すとともに,理想理論と非理想理論の構造的解釈の一つを与える。

abstract

This paper aims to show a connection between Rawls’s early works and A Theory of Justice. In particular, we examine concepts of rules and practices, which play important roles in the early works. These are closely related to constructive rules and institutional facts, which are proposed by John Searle. Given the close relationship, we show that a special class of rules is crucial for justice as fairness; it can serve as a foundation of justification of his conceptions of justice. We provide an interpretation of ideal and non-ideal theories from this perspective.
