abstract

John Rawls makes a list of the equal basic liberties. This essay pays attention to the status of political liberties (for example, the right to vote and to participate in politics) in the list. According to Banjamin Constant and Isaiah Berlin, freedom of thought and liberty of conscience (what Constant called ‘the liberties of the moderns’) are superior to political liberties (‘the liberties of the ancients’). Rawls admits that his conception of justice, justice as fairness, agrees with the strand of the liberal tradition (represented by Constant and Berlin) that regards the equal political liberties as having in general less intrinsic value than freedom of thought and liberty of conscience. However, Rawls adds that justice as fairness does not deny that some will find their good importantly in political life; thus for them this life is a central part of their complete good. Now, Rawls suggests that people with greater wealth and position usually control political life and enact legislation and social policies that advance their interest. So, he includes his first principle of justice a proviso that the equal political liberties, and only the liberties, are to be guaranteed their fair value. Does Rawls’s conception of justice keep faith with the liberal tradition of political thought from Constant to Berlin?
