抄録

　本稿の目的は，ジョン・ロールズの制度論を支える法観念を明らかにすることである．そのために，本稿は，ロールズが『正義論』全体を通じて参照する法哲学者のH・L・ A・ハートの業績に注目する．特に，制度を論じる『正義論』第2部において最もロールズが参照する，ハートの「自然権は存在するのか？」と題された論文を取り上げる．同論文とロールズ『正義論』第2部のテクストを比較した結果，とりわけ特定的権利に関して，公正原理を媒介とした権利と自由の関係をめぐるハートの議論が，ロールズの制度 論を法的に支える要素であることが判明する．そのことは，ハートとロールズが，『正義論』の公刊の時点において，立憲的でリベラルな政体を基礎づける法観念という深いレベルで共鳴していたことを示すものである．さらに，ハートとロールズが提起した「権利」「正義」「自由」という三者の関係は，新たな社会像および制度を模索する現在の情況において，依然として重要な問いを提起している．

abstract

The aim of this paper is to clarify the legal conception on which John Rawls based his argument about the institutions. This paper focuses on the relationship between J. Rawls and H. L. A. Hart. Especially, this paper examines the significance of Hart’s article “Are There Any Natural Right?” in Rawls’ argument. By comparing the texts of the Part II of A Theory of Justice and Hart’s article, it becomes clear that Rawls’ argument about institutions relies on the conception of right that Hart developed in his article. This reliance shows the fact that Rawls and Hart share the liberal idea of right at the time of the publication of A Theory of Justice.
