抄録

　本稿の目的は次の3点にある．第一に，本プロジェクトが実施した2014年訴訟記録調査の方法と調査内容を詳しく説明することである．その際，2004年に実施された先行調査との違いにも言及する．第二に，最高裁判所が公表しているデータや資料との照合を行いながら，調査の主な項目に関する集計結果を概観することである．そして第三に，2004年調査の結果との比較を行うことである．この比較からは，10年の間の法的ニーズの変容，過払金返還請求訴訟の増加，あるいは大都市圏への訴訟の集中などを見出すことができ，社会ないし経済状況の変化を背景として訴訟の機能や役割が変質しつつあることが示唆される．

abstract

The purpose of this paper is threefold. Firstly, we explain the methods and details of the 2014 civil case file research conducted by our project. The differences from the previous research conducted in 2004 are also mentioned. Secondly, we outline the summary of the main items of the research, collating it with the data and materials published by the Supreme Court. And thirdly, we compare them with the results of the 2004 research. From this comparison, it can be observed that legal needs have changed over the past decade, the number of litigation cases seeking reimbursement has increased, and the number of cases is concentrated in metropolitan areas. It is suggested that the functions and roles of civil litigation are changing.
