抄録

　民法典は、法解釈者に対して、新型コロナウイルス感染症に起因する危機の克服を可能とする一連の道具立てを提供する。第一に、前例のない今次の危機は、予見不可能性を特徴とするが、そこからもたらされる帰結は契約法上の諸手段によって制御可能である。第二に、公衆衛生上の緊急事態と契約の不可侵性の原則とが組み合わされると、契約当事者間に過大な不均衡がもたらされかねないが、民法典の諸規定は行き過ぎを是正しうるはずである。第三に、危機は悪意のある者にとってはときに好機となるが、不誠実な行為に対するサンクションとして契約法を用いることができる。
　不予見の制御、不均衡の抑制、不誠実の制裁。以上の３点が、危機的状況の克服にあたってフランス契約法が提供する道具立てである。

（フランス語） Le Code civil offre aux interprètes de la loi toute une série d’outils permettant de surmonter cette crise. La crise se caractérise en premier lieu par sa nature sans précédent. Cette imprévisibilité de la crise et de ses conséquences peut être gérée par certains outils contractuels. En deuxième lieu, la combinaison de la situation sanitaire et du principe d’intangibilité du contrat est la source de déséquilibres excessifs. Certaines dispositions devraient permettre de réduire ces excès. En troisième et dernier lieu, la crise est souvent une opportunité pour certaines personnes mal intentionnées. Le droit des contrats met également à la disposition des interprètes des moyens de sanctionner la déloyauté.
Gérer l’imprévu, réduire l’excès, sanctionner la déloyauté, voici les principaux outils que le droit français des contrats met à notre disposition pour surmonter cette période de crise.

（英語） The Civil Code offers interpreters of the law a range of tools to overcome this crisis. The crisis is characterized first and foremost by its unprecedented nature. This unpredictability of the crisis and its consequences can be managed by certain contractual tools. Secondly, the combination of the health situation and the principle of the intangibility of the contract is the source of excessive imbalances. Certain provisions should make it possible to reduce these excesses. Thirdly and finally, the crisis is often an opportunity for some ill-intentioned people. Contract law also provides interpreters with the means to sanction disloyalty.
Managing the unforeseen, reducing excesses, sanctioning disloyalty, these are the main tools that French contract law puts at our disposal to overcome this period of crisis.
