概要

　本論文では，ジョン・ロールズの初期論文から『正義論』にかけて展開された「フェアプレイの義務」（あるいは「公正の原理」）の方法上の意義を検討する．まず，ロールズにとって実践におけるフェアプレイの義務の問題が，「公正としての正義」という彼のプロジェクトの中核にあることを論じる．このフェアプレイの義務は，ハーバート・ハートの概念分析に大きな影響を受けつつも，公共財の過少供給の克服という経済学で広く扱われている問題の一形態とも捉えられる．まず，フェアプレイの義務に関して，ハートとロールズの間に問題の捉え方について本質的差異があることを明らかにする．また，ロールズの議論を検討して，経済分析に還元されない概念分析の役割が，政治哲学に存在することを論じる．

abstract

This paper examines the theoretical implications of the “duty of fair play” (or “principle of fairness”) developed by John Rawls from his early papers through his Theory of Justice. First, we argue that for Rawls, the issue of the duty of fair play in practice is at the heart of his project of Justice as Fairness　(注)【Justice as Fairnessはイタリック体】. His idea on the duty of fair play, while heavily influenced by Herbert Hart's conceptual analysis, can also be seen as a form of the problem widely addressed in the field of public economics (i.e., suboptimality of the provision of public goods). With respect to the duty of fair play, we clarify an essential difference between Hart and Rawls in how they view the issue. We also argue that there is a role for conceptual analysis in political philosophy that cannot be reduced to economic analysis.
