概要

　学説が実務に対して影響を与えているのか，与えているとすればそれはいかなる程度なのか, という問いは，法学者のみならず，法システムの作動過程を研究領域の1つとする法社会学者にとっても，重要な意味を有する．本稿では，不法行為法に関する高等裁判所の判決文を題材として，伝統的通説とされる相関関係説の影響の程度を類型化することを通じて，これを把握することを目的とする．分析に際しては，計量テキスト分析を中心に用いた．分析には，相関関係説の影響の程度と事案の関連性の有無に焦点を当てた．その結果，医療過誤事案や債務不履行に基づく損害賠償請求も問題となる事案では関連性がないものの，自動車事故・労働問題・取引的不法行為の一部においては関連性を認めうることが分かった．以上を踏まえて，相関関係説の実務への影響についての諸課題を示す．

Abstract

The question of whether（or how）legal dogmatic influences legal practice is important for both legal scholars and legal sociologists. The purpose of this article is to assess the degree of influence exerted by the established dogmatic in Japanese tort law, referred to as “correlation dogmatic（sôkankankei-setsu）,” on judicial decisions in tort law through quantitative text analysis（and close reading）. The results suggest that, while correlation dogmatic appears to have little relevance in cases such as medical malpractice, it does seem to influence cases involving automobile accidents, labor disputes, and transactional torts. Based on this analysis, the article raises questions about the impact of correlation dogmatic on legal practice.
